DoI isn't owned by anyone, so you don't have to ask specifically to make a Spy, but to write stories with them, you need standard Permission.

That's assuming by 'badfic reports' you mean the usual combination of an account of the Spy's adventure in the story, followed by a formal report giving details to any agent who might be assigned to it. If you just wanted to write the formal report (Title, Type of Badfic, whatever else we put on them - can't get at the Wiki to check), which would basically be like sharing it on the Board but attaching an agent's name to it, I don't see that you'd need Permission for that.
